The Standing Senate Committee on Legal and Constitutional Affairs has the honour to present its

SEVENTH REPORT

Your committee, to which was referred Bill C-5, An Act to amend the Criminal Code and the Controlled Drugs and Substances Act, has, in obedience to the order of reference of Wednesday, June 22, 2022, examined the said bill and now reports the same without amendment but with certain observations, which are appended to this report.

Observations to the Seventh Report of the Standing Senate Committee on Legal and Constitutional Affairs (Bill C-5)

Diversion measures for illegal substance possession

According to the Minister of Justice, Bill C-5’s amendments to the Controlled Drugs and Substances Act recognize “that substance abuse is primarily a health and social issue best addressed through prevention and treatment.” These changes will require police and prosecutors to consider not pursuing charges against individuals found in simple possession of illegal substances. Instead, police must consider issuing a warning, diverting them to appropriate resources, or to take no further action.

In order for this approach to be successful, the committee is mindful that the Government of Canada must help ensure that:

Diversion programs and health and substance use programs are properly developed, adequately resourced, and made available across the country to all Canadians;

Police and prosecutors are trained to divert individuals caught in possession of an illegal substance towards programs suitable for their needs;

The discretion afforded to police and prosecutors by Bill C-5 does not result in further entrenching systemic discrimination;

Systems are developed to monitor and ensure that police are using warnings and diverting individuals as appropriate and only charging them under the Controlled Drugs and Substances Act when necessary;

Adequate data is collected and research and analysis are performed to determine whether the amendments are producing the desired shift in Canada’s approach to substance use in the years ahead; and

Continued consultation is carried out by the Government of Canada with provincial government counterparts and relevant stakeholders, including police, prosecutors, substance users, health professionals, representatives from affected Indigenous, Black, racialized or marginalized communities, among others, to ensure that more positive outcomes are achieved in treating substance use as a public health issue, reducing stigmatization of users, and reducing opioid overdoses.

The committee is also aware that these amendments will not on their own be sufficient to stem the harms caused by the opioid overdose crisis in Canada and that urgent action must be taken by the Government of Canada to help Canadians and prevent further loss of life.

That the sixth report of the Standing Senate Committee on Agriculture and Forestry, entitled Treading Water: The impact of and response to the 2021 British Columbia floods, deposited with the Clerk of the Senate on October 27, 2022, be adopted and that, pursuant to rule 12-24(1), the Senate request a complete and detailed response from the government, with the Minister of Agriculture and Agri-Food being identified as minister responsible for responding to the report, in consultation with the Minister of Environment and Climate Change, the Minister of Intergovernmental Affairs, Infrastructure and Communities and the Minister of Transport.
